About these Terms
These Terms of Service ("Terms") apply to your use of the Coveted Collection website and client portal (the "Portal"). The Portal is operated by [DECISION LD-01: legal entity name and type] ("Coveted Collection", "we", "us").
[DECISION LD-12: how and when users accept these Terms, and whether existing users must accept before continuing]
These Terms cover your use of the website and Portal only. They do not create a consignment relationship and they do not replace any separate signed agreement. See "Separate signed agreements" below.
Eligibility
Access to the Portal is by invitation. An invitation is personal to the person or client account it was issued for.
To use the Portal you must:
- be at least [DECISION LD-04: minimum age] years old
- be able to enter into a binding agreement
- if you act for a business, have authority to act for it [DECISION LD-04: authority wording for business clients]
[DECISION LD-09: any limits on where the Portal is offered]
Your account
You are responsible for:
- giving accurate information and telling us when it changes
- keeping your sign-in details, second-factor device and backup codes under your control
- all activity under your account that results from your failure to protect them [DECISION LD-05: attorney wording on responsibility for account activity]
An account is for one person. Do not share it, sell it or let anyone else use it.
If you have lost access to your account, contact us. We may ask you to prove who you are before restoring access. [DECISION LD-16: acceptable identity-verification methods] [DECISION LD-15: approval required to reset multi-factor authentication]
[DECISION LD-14: any approved alternate verification for clients with no email on record]
Security obligations
The Portal requires multi-factor authentication for every user. [DECISION LD-22: confirm the second factor offered at launch]
You agree to:
- keep your password and second factor secure
- keep your invitation link private and use it only for yourself
- sign out of shared devices
- tell us promptly if you believe your account has been used without your permission, at [DECISION LD-01: security contact]
- not try to get around any security or access control
Acceptable use
You may use the Portal only for its intended purpose: to view and manage your own account, cards, submissions and related records.
You must not:
- access, or try to access, another client's information or any part of the Portal you are not authorised to use
- share an invitation link, session or sign-in details
- probe, scan or test the Portal for vulnerabilities without our written permission
- interfere with the Portal, or place an unreasonable load on it
- use bots, scrapers or other automated tools to access or copy the Portal
- upload or submit anything unlawful, harmful or misleading, or anything you have no right to submit
- use the Portal to break any law or the rights of others
Portal availability and limitations
The Portal may change, and it may be unavailable at times, including for maintenance, security or reasons outside our control. We may add, change or remove features.
Information in the Portal reflects our records at the time you view it and may be delayed or incomplete. In particular:
- Card details and suggestions. Some card details begin as automated suggestions, including suggestions produced with an AI service. They are not final until our staff have verified them.
- Grades and values. Any estimated grade or value shown in the Portal is not a guarantee of a final grade, price or outcome.
- Third-party information. Some information may come from third parties such as grading companies or marketplaces. We do not control those services.
- Invoices and balances. The Portal shows amounts from our records. It does not currently accept card payments. [DECISION LD-24: how clients pay, and how payment status is confirmed]
Intellectual property
The Portal, including its software, design, text and branding, belongs to us or our licensors. These Terms give you a limited, personal, non-transferable right to use the Portal for its intended purpose. You may not copy, resell or reverse engineer it, except as the law allows.
Trading cards and related images may show artwork, names and marks that belong to third parties. Nothing in the Portal gives you rights in them. References to third-party companies do not imply that they endorse us. [DECISION LD-26: statement on third-party marks and non-affiliation]
[DECISION LD-26: ownership and permitted use of card photographs and of content you submit, including any licence to us]
[DECISION LD-26: process for intellectual property complaints]
Separate signed agreements
Some services, including consignment, are governed by a separate agreement that you sign with us.
- The signed consignment agreement controls consignment. These Terms do not replace it, change it or add to it.
- If these Terms and a separate signed agreement conflict on the subject of that agreement, the signed agreement applies. [DECISION LD-27: final order-of-precedence wording]
- Accepting these Terms does not by itself create a consignment relationship or set any commission, fee or payout term.
- Commission terms apply only under a signed agreement. [DECISION LD-27: treatment of clients with no signed agreement]
Disclaimers
[DECISION LD-05: attorney-reviewed warranty disclaimer, including the Portal being provided "as is" and "as available" if adopted]
[DECISION LD-05: attorney-reviewed disclaimer for estimated grades, values, AI suggestions and third-party information]
Nothing in these Terms excludes any right you have that the law does not allow us to exclude.
Limitation of liability
[DECISION LD-05: whether liability is limited, the amount of any cap, and any excluded types of loss]
[DECISION LD-05: whether an indemnity applies]
These website Terms do not set out responsibility for physical cards in our custody. That subject belongs in your signed agreement. [DECISION LD-27: confirm that custody and loss of cards are addressed only in the signed agreement]
Account suspension and termination
We may restrict, suspend or end access to the Portal. [DECISION LD-25: grounds, notice and any right to respond]
You may ask us to close your account by contacting us. [DECISION LD-25: how a user closes an account]
Ending Portal access does not by itself end any separate signed agreement, or change the status of cards in our custody or any open transaction. [DECISION LD-25: effect on cards in custody and open transactions]
We keep some records after an account ends. The Privacy Policy explains this.
Changes to these Terms
We may update these Terms. Each version has a version number and effective date.
[DECISION LD-13: what counts as a material update, how much notice is given, and how notice is delivered]
